Would suicide void a life insurance policy and would it be considered "accidental death"?

I need to know if suicide would result in payment on a life insurance policy as my brother has recently committed suicide.

Thanks,
Deborah

I'm sorry to hear about your loss. Usually, life insurance policies have a two year contestibility clause. This means if your brother committed suicide within two years of purchasing his life insurance policy the policy will not pay. If he has had his policy longer than two years then you should be able to collect on his policy.

I concur with Byron.

I will add to this a little. First, you are correct about the two year contestability, if after two years from issue, the company has to pay. If within the two years, you need to ask the insurance company, as many companies will pay if the cannot prove there were any plans or intentions prior to the issue of the policy. This can be based on state regulations forcing the insurance company.
First, you should call your state insurance department and ask them for the regulation in your state, then call the insurance company and ask them.

Good luck, and sorry for your loss.

Sorry, forgot to answer other question...no, it would not be considered an accident, so if life insurance is accidental only, it will not pay.

I respectfully add this: ask an insurance coverage attorney of your choice, not the life insurance company which will deny the claim.

Assuming that the suicide clause in question is applicable (a separate discussion), there is a legal presumption against suicide in most jurisdictions. Suicide, in civil jurisprudence, generally requires not only self destruction but the intent to effect it, which entails proof that is frequently circumstantial and- depending on the facts- unpersuasive to a jury. Do not assume, therefore, that the situation is as cut and dried as might first appear.

Please accept my sympathy on your loss.

Sorry about your loss. Consult a lawyer for legal advice. Whether the policy is payable is usually determinable from its terms or from relevant state law.

The contestable period does not pertain specfically to suicide. There is often a seperate suicide exlusion period. Most commonly it is one year, but it may be two. I believe Florida gives insurers a choice whether or not they want to cover suicide at all; however, competitive reasons usually cause insurers to cover it after one year. Check your policy for the specific terms. The previous responder is also correct that there is often a presumption against suicide. Consulting an attorney is a good idea if a claim is denied; however, most companies consider claims a cost of doign business and do pay the claims they owe.

What if someone changes the beneficiary on a policy and commits suicide less then 24 hours after make this change? Is there a chance for the original beneficiaries to contest the change under the time frame and circumstances which it was carried out?

Someone in my immediately family committed suicide by drinking a bunch of chemicals and the coroner determined it accidental, so we got the extra accidental life insurance benefit.

Is that super life insurance as my mum committed suicide last year?

To me somewhere, please don't do what u appear to be considering. Your boys would rather live with u in a tin shack than live w/o u. Think of your boys and how hurt they would be to lose you. Let your love for them strengthen your desire to live. You deserve the best in life and love

I have life insurance through my employer. Is there any difference between a group policy or individually purchased insurance?

I know sombody who's pushing 60, has not worked in about a year and is going broke, always trying to better himself and find a new career, but to no avail. Has a wife and grown kids who really love him. Paid about $1,300.00 a month for 15 years to keep the family in heath insurance, but now has had none for 2 years, due to lack of income. However has life insurance. No friends and has immediate family that disdains him, feels pretty worthless at this time in his life. this guy is not suicidal, but sometimes think he wouldn't fight a major illness.

I totally understand. If I had a terminal illness I also wouldn't get medical treatment. I do have health and life ins thru my job. However i'm so tired of all the pain and emptiness in my loser life. They can't force me to get medical treatment. So when I die the life ins company better pay up. That's not technically suicide.
